Measures of Shenzhen Transportation Bureau for the administration of integrity evaluation of road passenger transport enterprises

Chapter I   total   be

Article 1   In order to standardize the quality reputation assessment and integrity evaluation of road passenger transport enterprises (hereinafter referred to as road passenger transport enterprises), objectively evaluate the comprehensive service level of road passenger transport enterprises, effectively give play to the incentive and guiding role of the assessment results, and promote enterprises to strengthen management, ensure safety, integrity management and high-quality service, according to the planning outline for the construction of social credit system of the State Council (2014-2020), regulations of the people's Republic of China on road transport, regulations of Guangdong Province on road transport, regulations on the administration of road passenger transport and passenger stations and other relevant provisions are formulated in combination with the actual situation of this city.

Article 2   These Measures shall be observed when evaluating the integrity of road passenger transport enterprises in this Municipality.

Article 3   Integrity evaluation refers to the comprehensive evaluation of the enterprise's operation and management, safety production, service quality, social responsibility, honesty and trustworthiness within the evaluation year.

Article 4   Integrity evaluation shall follow the principles of openness, fairness and impartiality.

Article 5   The municipal competent department of transportation is responsible for organizing and implementing the integrity evaluation of the city's road passenger transport enterprises.

Chapter II   Evaluation index and grade division

Article 6   The integrity evaluation grade of road passenger transport enterprises is divided into excellent, excellent, qualified, basically qualified and unqualified according to the comprehensive quality reputation assessment and negative integrity evaluation results, which are expressed by AAAA, AAA, AA, a and B respectively.

Article 7   The integrity evaluation indicators of road passenger transport enterprises include quality reputation evaluation indicators and negative integrity evaluation indicators, including:

(1) The quality reputation assessment index implements the scoring system, with a total score of 1100. The quality reputation assessment score is used as the score of the enterprise integrity evaluation result and as the basis for defining the enterprise evaluation grade.

(2) The negative score of the integrity negative evaluation index is recorded to determine the integrity of the enterprise. It is not included in the enterprise evaluation score, but used as the basis for the degradation of the enterprise evaluation grade.

Article 8   The quality reputation assessment indicators of road passenger transport enterprises include basic indicators and additional indicators, including:

(1) The basic indicators include four first-class score deduction indicators of operation and management, safety production, service quality and social responsibility, with a score of 1000 points;

(2) The bonus indicators include three first-class bonus indicators, including award-winning situation (including integrity Award), management innovation and technological innovation, with a score of 100 points.

Article 9   Negative evaluation of integrity refers to the fact that an enterprise is tried by judicial organs, notified by government departments such as market supervision, public security, taxation, human resources and social security, and listed as a bad record by the bank insurance regulatory authority in terms of discipline and law-abiding, contract performance, credit records and other business reputation.

The negative evaluation indicators of integrity include five secondary indicators: contract performance, labor disputes, debt management, standardized operation and illegal acts. Every time an enterprise is judged, notified and included in the negative information of integrity, the corresponding negative score shall be recorded according to the severity, and the negative score shall not be recorded in the total evaluation score. When the same matter of an enterprise is notified or recorded by multiple departments (Institutions), the Department shall In case of different levels (Institutions), take the negative integrity information reported or recorded by the Department (institution) with higher level; in case of the same level of departments (Institutions), take any one of the negative integrity information reported or recorded.

If the negative score of a single index in the negative evaluation of integrity reaches 100, the enterprise's evaluation of this index is recorded as negative integrity.

Article 10   According to the characteristics of the road passenger transport industry, different secondary assessment indicators are set under the primary indicators of the integrity evaluation of road passenger transport enterprises (see the annex "integrity evaluation index system of road passenger transport enterprises" for details).

Article 11   Credit rating standard for road passenger transport enterprises:

(1) During the evaluation period, if the evaluated object meets the following conditions at the same time, its evaluation grade is AAAA:

1. There is no traffic accident with the same or more responsibilities for personal death;

2. The safety production standardization assessment meets the standard;

3. There is no major malignant pollution liability accident;

4. There are no major malignant service quality events;

5. The quality reputation assessment score is 950 or above;

6. The quality reputation assessment score ranks in the top 10% of the industry (in the top 10%, if the evaluation score of the last ranked enterprise is the same as that of the adjacent enterprises, the same sub enterprises will be entered).

(2) During the evaluation period, if the evaluated object meets the following conditions at the same time, its evaluation grade is AAA:

1. The number of traffic accidents with the same or more responsibilities in which people die shall not be more than 1, and the number of deaths shall not be more than 1;

2. The safety production standardization assessment meets the standard;

3. There is no major malignant pollution liability accident;

4. There are no major malignant service quality events;

5. The quality reputation assessment score is 850 or above.

(3) During the evaluation period, if the evaluated object meets the following conditions at the same time, the evaluation grade is AA:

1. During the evaluation period, the cumulative number of traffic accidents with the same or more deaths shall not be more than 2, and the number of deaths shall not be more than 2;

2. The safety production standardization assessment meets the standard;

3. There is no major malignant pollution liability accident;

4. There are no major malignant service quality events;

5. The quality reputation assessment score is 700 or above.

(4) During the evaluation period, if the evaluated object meets the following conditions at the same time, its evaluation grade is grade A:

1. During the evaluation period, the cumulative number of traffic accidents with the same or more deaths shall not be more than 3, and the number of deaths shall not be more than 3;

2. The safety production standardization assessment meets the standard;

3. There is no major malignant pollution liability accident;

4. There are no major malignant service quality events;

5. The quality reputation assessment score is 600 or above.

(5) During the evaluation period, if the evaluated object is under any of the following circumstances, its evaluation grade is grade B:

1. During the evaluation period, the cumulative number of traffic accidents with the same or more deaths is more than 3, or more than 3 people are killed;

2. The safety production standardization assessment fails to meet the standard;

3. A major malignant pollution liability accident occurs;

4. A major malignant service quality event occurs;

5. Listed in the key safety supervision objects (blacklist) of the provincial transportation department and the Shenzhen transportation department;

6. The score of quality reputation assessment is lower than 600;

7. More than 30% of the subsidiaries and branches of the enterprise are assessed as grade B;

8. Fail to participate in the annual evaluation as required, or fail to submit evaluation materials as required and refuse to make corrections;

9. Practicing fraud, concealing information or providing false information in the evaluation process, which is verified by investigation;

10. Because the enterprise violates relevant national laws and regulations and the provisions of industry management departments, employees violate the provisions of the regulations on letters and visits, have extreme behavior, repetition, leapfrog, group visits and letters and visits, seriously disrupt social order and cause adverse social impact;

11. Enterprises unilaterally interpret relevant policies and regulations of industry management, create public opinion pressure, and cause instability of the industry.

The "major malignant pollution liability accident" mentioned in these Measures refers to the accident that is classified as a major environmental event (Level II) according to the national emergency plan for environmental emergencies.

The extremely vicious service quality events mentioned in these Measures refer to the service quality events that cause serious personal injury or major property loss to the service object, or have a bad impact on the society due to the reasons of the evaluated enterprise, and are criticized by the competent transportation department at or above the municipal level.

The traffic accident referred to in these Measures refers to the traffic accident in which the driver bears the same or more responsibilities.

Article 12   In the evaluation cycle, for each negative integrity index recorded in the negative integrity evaluation, it shall be reduced by 1 level based on the enterprise evaluation level specified in Article 11 until it is reduced to B level.

Chapter III   Organization and Implementation

Article 13   The integrity evaluation of road passenger transport enterprises shall be conducted once a year. The evaluation cycle is from January 1 to December 31 every year. The integrity evaluation shall be completed before June 30 of the next year.

Article 14   The evaluation of wholly-owned subsidiaries, absolute or relative holding subsidiaries and branches of the enterprise shall be carried out respectively. The relevant data (original data) related to quality reputation assessment in the evaluation of wholly-owned subsidiaries and branches of the enterprise shall be fully included in the evaluation data of the enterprise, and the relevant data (original data) related to quality reputation assessment in the evaluation of absolute or relative holding subsidiaries It is included in the evaluation data of the enterprise according to the holding proportion of the enterprise.

Article 15   The integrity evaluation of road passenger transport enterprises is carried out through the integrity evaluation information system of road passenger transport enterprises (hereinafter referred to as the evaluation system). The evaluation system consists of the information management port of the municipal competent department of transportation and the information input port of road passenger transport enterprises.

Article 16   The municipal competent department of transportation is responsible for the establishment of electronic archives of the evaluation system of road passenger transport enterprises within the administrative area of the city, as well as the collection, entry and management of evaluation data. The newly added enterprises shall file from the date of issuance of the business license, only record the evaluation information in the current year, and participate in the evaluation from the next year.

Article 17   The evaluation data of road passenger transport enterprises are divided into four categories: information system data, on-site inspection data, daily record data and enterprise filling data. All kinds of data are collected in the following ways:

(1) The data of the information system is automatically obtained through the connection between the evaluation system and various road transportation management information systems. If it cannot be obtained through the evaluation system for the time being, the municipal competent department of transportation is responsible for organizing the acquisition and entering it into the evaluation system.

If an enterprise has any objection to the "vehicle satellite positioning online rate" and "vehicle overspeed rate" obtained by the road passenger vehicle satellite positioning monitoring system, it may appeal to the municipal competent department of transportation. The municipal competent department of transportation shall verify the authenticity of the data and correct it according to the facts.

(2) The on-site inspection data shall be obtained through the on-site inspection of road passenger transport enterprises organized by the municipal competent department of transportation. The inspection shall be conducted once a year. The inspectors shall fill in the inspection record form during the inspection and be responsible for inputting the relevant data into the evaluation system within 5 working days after the completion of the inspection.

The on-site inspection can be carried out in combination with other special inspections in the industry. The text of the evaluation data obtained by on-site inspection shall be kept by the evaluation entry unit for future reference, and the retention period shall not be less than 3 years.

(3) The daily recorded data shall be timely entered into the evaluation system by the full-time personnel designated by the municipal competent department of transportation.

(IV) The data filled in by the enterprise shall be entered by the enterprise through the enterprise port of the evaluation system, including the basic information of the enterprise, the information of the employees of the enterprise and the information required by the evaluation, and the relevant written materials shall be uploaded. The enterprise shall update the filled information in time, and the information involved in the evaluation index shall be updated at least once a year. The ranking of integrity evaluation is affected due to the enterprise's misstatement, omission of information and other reasons, It shall be borne by the enterprise itself.

(5) If the above data needs to be modified and adjusted after entry, it shall be handled in accordance with the procedures specified in the evaluation system. For enterprises and intermediaries certified by the municipal competent department of transportation, their relevant complaint handling and satisfaction data can be used as the basis for the integrity evaluation of road passenger transport enterprises.

Article 18   The municipal competent department of transportation shall promote the collection of integrity information, establish an integrity information sharing mechanism with administrative departments such as market supervision, public security, taxation, human resources and social security and banking and insurance regulatory institutions, and update the acquired integrity information in the evaluation system every six months.

Article 19   Before March 30 of each year, the evaluation system will automatically generate the preliminary evaluation results of the integrity evaluation score and grade of each road passenger transport enterprise in the previous year.

Article 20   The municipal competent department of transportation shall review the preliminary evaluation results of road passenger transport enterprises. If there is obvious difference between the preliminary evaluation results and the actual situation of the enterprises, it shall timely verify and update the information in accordance with the procedures specified in the evaluation system. The reviewed preliminary evaluation results shall be fed back to the assessed enterprises.

Article 21   The municipal competent department of transportation shall publicize the audit results on the Shenzhen portal website for no less than 15 working days. During the publicity period, any unit or individual who disagrees with the preliminary evaluation results of the assessed enterprise may raise a written objection to the municipal competent department of transportation and provide relevant supporting materials. Anonymous reports or letters will not be accepted.

The municipal competent department of transportation shall verify the objections raised by the enterprise, handle them within 20 working days from the date of acceptance, make a reply of correction or no correction, and correct the relevant data according to the procedures specified in the evaluation system.

Article 22   The evaluation system automatically generates the final evaluation results of the score, grade and ranking of the quality reputation and integrity evaluation of the city's road passenger transport enterprises in the previous year according to the revised data after the preliminary evaluation publicity.

Article 23   The municipal department in charge of transportation shall evaluate the list of AAAA level enterprises according to the final evaluation results.

Article 24   The evaluation results of road passenger transport enterprises are published on the portal of Shenzhen transportation department and other relevant news media, and provide query services for the public to expand the application scope of the evaluation results.

The road passenger transport enterprises participating in the evaluation shall disclose their latest evaluation results to the public in their external service places and prominent positions on the company's website.

Chapter IV   policy of awards and penalties

Article 25   Road passenger transport enterprises with an evaluation level of "AAAA" enjoy priority in obtaining municipal financial subsidies, participating in municipal pilot projects, municipal evaluation and selection, and relevant business handling under the same conditions in the field of road passenger transport.

Strong and excellent municipal road passenger transport enterprises should be generated from enterprises with evaluation grade of "AAAA".

Article 26   When implementing the license of road passenger transport management right, the municipal competent department of transportation shall refer to the evaluation results of passenger transport enterprises:

(I) If the service quality bidding method is adopted to implement the license of new road passenger transport operation right, the evaluation grade of passenger transport enterprises shall be taken as an important evaluation content in bid evaluation; if the service quality bidding method is not adopted, the evaluation grade of passenger transport enterprises in recent three years shall be compared year by year and the license shall be selected. For example, the evaluation grades of enterprises in recent three years are the same, According to the evaluation score of the most recent year, the person with high score will be given priority;

(2) If a road passenger transport enterprise continues to apply for operation after the operation period of the original road passenger transport line expires, it shall be implemented in accordance with the provisions on the administration of road passenger transport and passenger stations and the relevant provisions of the provincial competent department of transportation on the evaluation and assessment of the integrity of road passenger transport enterprises.

Article 27   If the enterprise was evaluated as class A in the previous year, the municipal competent department of transportation shall order it to make rectification for a period of three months.
